I saw that they had the rights to the Supernova graphics, but didn't assume that they had the rights to Stars! itself.
I see now that they appear to own all former Empire IP.

Dang, I was hoping it'd be available somehow.

Given the age of the game, and the fact that it is in essence abbandoned you may beable to try and claim a copy right, of course would depend on where you live and what the laws exactly are. You may also simply try contacting them about them donating the rights to you or a marginal payment for them since its clearly not a money earner for them it might just work.

I sent the URL of this thread to Jeff McBride and he replied:
It is rather moot. Empire never had the source code, artwork or music for any version of Stars!. Also, our contract with them had the rights to the name revert to us after they stopped selling the game."
