Here's the response I got from Empire's customer support when I inquired about Empire making Stars! available via download:
Quote: | The last stock of this delisted game was sold a few months ago. The product is now classed as delisted and will not be produced or supported any longer due to the age of the program.
We have been looking at Digital Retail for sometime and considering titles that could be used. We can pass on your request but cannot guarantee that this will be made available for download if and when we decide to use Digital Retail. Unfortunately like many old games they come to an end regarding their age or compatibility with drivers / operating systems etc and many are then removed from production and sale.
Thank you for contacting us regarding this. We will pass on the information to the people who are considering the Digital Retail option.

I can see why they wouldn't want to support it, and I can't say I'm surprised by the response, but it wouldn't kill them to just give it away at this point. Argh. Now I'm just venting...sorry.

Would not kill them but is likely inconvenient. Empire has aquired only distribution and supporting rights not giving away rights from Jeffs. Some law jackals may try to rape them.
Typically such "delisted" games are distributed by abandonware sites (and page for Stars! is already there but links that Tuomas from Stockmann still sells serials):
